General Terms and Conditions
These General Terms and Conditions govern the use of the Kaikō Travel website and the contracting of the transfer services offered through it.
1. Service owner
In accordance with Article 10 of Spanish Law 34/2002 of 11 July on Information Society Services and Electronic Commerce (LSSICE), the identifying details of the website owner are set out below. 2. Use of the website
The Kaikō Travel website is created for information purposes and to manage the transfer booking services offered by Kaikō Travel.
3. Services
Kaikō Travel provides specialised, professional transfer services, with different service and vehicle options. We specialise in services for individuals and companies, offering different vehicle types according to the client's needs.
4. Bookings
In the booking section, the client can select the date, time, pick-up point and destination, as well as any other relevant circumstance (luggage, tolls, additional stops, passengers, child restraint systems, etc.) in order to calculate the price. If you require a customised service not detailed on the website, you can request it through our contact form to receive a price for the requested service.
5. Booking confirmation
Kaikō Travel has 4 hours to confirm the booking made by the client, and does not guarantee availability if the booking is requested less than 4 hours before the date and time the transfer starts. Where payment is made by bank transfer, the 4-hour confirmation period starts to run once Kaikō Travel receives the transfer. To use the booked service, the client must keep the booking confirmation in electronic or paper form and have it available for the driver if requested. If there is any disagreement regarding the booked service and the client does not present the booking confirmation, this may mean the service is not provided.
6. Changing and cancelling a booking
Requests to change a booking must be made by replying to the confirmation email and take no effect until they are received and confirmed by email. Change requests must be made at least 4 hours before the date and time set in the original booking, always subject to availability and to whether the requested change can be made. Booking cancellations must be made at least 48 hours before the date and time scheduled for the start of the service.
7. Vehicles
For all vehicles offered, the stated number of seats refers to the seats available to the client; the vehicle's capacity is the stated number of seats plus the driver's. Vehicles used for the transfer service will hold the authorisations, licences and insurance required to provide the services, in accordance with applicable regulations. Drivers will have the experience and training needed to offer the best conditions of satisfaction during journeys. For operational and availability reasons, the service may be provided with a vehicle of a higher category or with more seats than the one booked, at no extra cost. Likewise, where strictly necessary due to events of force majeure, a lower-range vehicle may be provided in order to make the service possible, refunding, where applicable, the cost difference between the vehicle originally booked and the one finally provided.
8. Fares
The fares shown on the website are based on the fastest route between the point of origin and the destination. If the client wishes to choose an alternative route, they must specify this in the ADDITIONAL INFORMATION field when completing the booking, or contact Kaikō Travel for a quote adapted to the chosen route. Fares do not include the cost of tolls or car-park charges, unless expressly stated otherwise. When completing the booking, the client may choose to use toll motorways on routes where this is possible; in that case, the toll cost is added to the total for the service. The stated fares include the taxes applicable to the service.
9. Client pick-up: delays caused by the client
Pick-up will take place at the location, date and time indicated by the client in the booking. Airport pick-ups: the driver will wait a maximum of one additional hour from the time indicated by the client in the booking confirmation. If, before boarding, the client becomes aware of a flight delay of more than one hour, they must contact Kaikō Travel to check whether the service can be provided at a different time. Train station and seaport pick-ups: the driver will wait a maximum of thirty additional minutes from the time indicated in the booking confirmation. If the client becomes aware of a delay of more than thirty minutes, they must contact Kaikō Travel to check for a different time. Hotel and other address pick-ups: the driver will wait a maximum of 10 additional minutes from the time indicated in the booking confirmation. Before the waiting time is exceeded, the client must contact Kaikō Travel to ask the driver to wait and pay the corresponding additional cost before the service takes place; otherwise the service will not be provided. Waiting time requested by the client may involve an extra charge that varies according to the waiting time and vehicle type. If the established waiting time is exceeded without the client having contacted Kaikō Travel, Kaikō Travel reserves the right to cancel the service, with no right to a refund of the amounts paid. The client must provide a current email address and mobile phone number and report any change. It is essential to provide a mobile phone number on which Kaikō Travel can reach the client during the journey to urgently communicate any matter relating to the booking.
10. Client pick-up: delays caused by Kaikō Travel
The driver has a margin of 15 minutes' delay over the booking time, without this giving rise to any liability on the part of Kaikō Travel. If the driver does not arrive at the pick-up location once this 15-minute margin is exceeded, the client must contact the customer service phone number indicated in the booking confirmation. Failure to comply with this provision may mean that later complaints relating to the incident are not accepted where Kaikō Travel was not aware of it at the time it occurred.
11. Destination
The destination will be exclusively the one indicated by the client in the booking. If the client wants to make stops during the journey, they must indicate this when completing the booking. If the additional stops are outside the municipality of origin or destination, the client must report this, specifying the stops and the waiting time at each one, so that an accurate quote can be prepared. Kaikō Travel is not responsible where the client is late to catch a flight, train, bus, boat or other means of transport when the pick-up took place within the scheduled time margin and the journey was delayed due to traffic conditions or other circumstances beyond Kaikō Travel's control.
12. Parking and meeting points
The driver will park the vehicle as close as possible to the address indicated by the client, bearing in mind that certain addresses do not allow vehicles to park and/or stop. Unless we give the client specifically different information, the meeting points will be as follows: - At airports: inside the terminal, at the arrivals exit for the flight indicated in the booking, where passengers meet non-passengers. - At stations: inside the station, at the arrivals exit for the relevant train. - At hotels and similar: at the establishment's reception, or at the building entrance if there is no reception. - At homes, hospitals, offices and other locations: at the door or at the nearest point where the vehicle can park. All of the above in compliance with the rules of each site or area, especially in port and airport areas, where there may be permanent, temporary or occasional restrictions on access and parking, which passengers must comply with in order to start the service, contacting Kaikō Travel if they have any difficulty. Exceptional circumstances (roadworks, road closures, sporting or cultural events, demonstrations, vehicle characteristics, accessibility or others) may make it impossible for the vehicle to reach the requested pick-up location. In these situations, Kaikō Travel will call the number given in the booking to inform the client of the nearest point to meet the driver.
13. Luggage
Kaikō Travel is not responsible for a lack of boot capacity where the client brings more luggage than stated when choosing the vehicle type. For safety and in accordance with applicable regulations, all luggage must be carried in the vehicle's boot where appropriate. Luggage may not contain prohibited items such as dangerous substances, animals not declared during the booking process, firearms, perishable items or fragile objects. Kaikō Travel will not be liable for loss of or damage to luggage where this results from circumstances beyond its responsibility.
14. Minors
Where children under 12 are travelling, the booking process will include, where applicable, the option to select the most suitable child restraint system based on the child's age and weight. If the client does not report that they are travelling with children, transport is subject to the availability of child restraint systems in the vehicle. If no suitable system is available, Kaikō Travel may decline to provide the service where having one is legally required to carry out the transport.
15. Reduced mobility or special transport needs
The client must indicate whether they will travel with a wheelchair or a powered wheelchair when completing the booking request in the Additional Information field. They must also specify whether it is a folding or manual model or whether it includes a battery and/or motor, so that a service suitable for their transfer can be offered.
16. Pets
The client must indicate in the booking process, in the Additional Information field, whether they are travelling with pets. Pets must travel in accordance with the conditions and requirements applicable to the type of service and vehicle booked. In the event of a claim or lawsuit caused by the client's pet, the client must assume the legally applicable liability and compensation for the damage caused.
17. Cancellations
By the client: cancellations notified and confirmed 48 hours or more before the scheduled start time of the service may be eligible for a refund of the amount paid, in accordance with the applicable contract conditions. Cancellations notified less than 48 hours in advance do not give the right to a refund of the amount paid. The moment of cancellation is deemed to be when Kaikō Travel actually receives the communication through an enabled channel; the cancellation is not effective until it is received and, where applicable, confirmed by Kaikō Travel. By Kaikō Travel: if the client does not arrive at the meeting point within the established time from the time stated in the booking confirmation, Kaikō Travel may contact the phone number provided by the client. If it cannot reach the client (insufficient connection quality, no signal, voicemail active or no answer), the service may be cancelled with no obligation to provide it or to refund any amount paid by the client, unless another solution is legally required. Kaikō Travel will not pay any compensation for delay, cancellation or non-provision of a service due to a chance event or force majeure beyond its control, including, among others, traffic accidents, police checks, extreme weather conditions, road closures, strikes, demonstrations or other unforeseeable or unavoidable circumstances.
18. Reservation of rights
Drivers reserve the right not to allow into their vehicles any passenger who is under the influence of alcohol or other substances and who may endanger the normal course of the transfer, or whose conduct may endanger the physical or moral integrity of the driver and/or the other passengers. Smoking is not allowed inside the vehicles, in accordance with Spanish regulations.
19. Client responsibilities
When making a booking, the client: - Understands and accepts the general terms and conditions and undertakes to pay for the requested service using the payment method chosen. - Understands and accepts that they must report any change affecting their booking and the service within the terms and deadlines detailed in this document. - Accepts that the service will be carried out in accordance with the details provided during the booking process and under the conditions set out in this document. - Is obliged to check that all the details shown in the booking confirmation are correct and, in the event of an error, to notify Kaikō Travel far enough in advance for the change to be made, where possible. - Accepts that if their actions or those of the people travelling with them cause any damage during the service, they will be responsible for the harm caused to the carrier or to third parties where legally applicable. - Accepts that they must carry all documentation needed to cross borders, and that Kaikō Travel will not be responsible for costs or harm caused by not carrying the required documentation or by breaching the customs, police, tax authority or administrative rules of the countries for which entry is requested.
20. Complaints
If at any time during the service you notice a problem with the service provided, you can report it to us immediately through the phone number indicated in the booking confirmation. Kaikō Travel will investigate the problem and try to resolve it immediately. If we are not notified at the time, our ability to investigate or resolve the matter of the complaint may be affected. Drivers will carry, where legally required, the corresponding complaints book available to users who request it.
21. Changes to booking conditions
Kaikō Travel reserves the right to change fares, payment conditions and the cancellation policy, without such changes affecting bookings already made and confirmed before they take effect.
22. Payment methods
Bank transfer: once the booking is made, Kaikō Travel will provide the bank details for the transfer. Once notification of the deposit is received, Kaikō Travel will confirm the service within a maximum of 24 hours, subject to availability. We recommend keeping a copy of the bank transaction summary. Cash or card: the client will pay in cash or by card directly to the driver on arrival at the destination, where this option is available for the service booked. This payment method depends on the type of service booked and will be specified, where possible, during the booking process. For a return service, the cash payment may be made in full on arrival at the destination on the first outbound transfer, where the booking conditions so state.
23. Data protection policy
Personal data is processed in accordance with the applicable personal data protection regulations. Information about the Privacy Policy is available on the Kaikō Travel website: www.kaikotravel.com.
24. Data sharing
Kaikō Travel will not share personal data obtained through this website with third parties, except where there is a legal basis allowing it or where it is necessary for the correct provision of the service booked. Where necessary to provide the transfer service, the data strictly needed to carry out the booking and the transfer may be shared with the driver.
25. Information provided by the client
To make bookings on the website, each client must provide their personal data voluntarily and under their own responsibility; the data must be truthful and accurate. The client who completes the booking process declares that they are the owner of the information provided or, failing that, that they have authorisation from the person on whose behalf they are acting.
26. Use of the website by minors
Users may only contract and make bookings on the website if they are of legal age. Otherwise, responsibility for making bookings lies with the minor's parents or legal guardians, under the terms established by applicable law.
27. Exclusion of liability
Kaikō Travel is exempt from liability, in the cases legally permitted, where the following occur: - Interruptions to the normal operation of the website due to force majeure or causes not attributable to Kaikō Travel. - Technical issues that cause the web service to be wholly or partly unavailable. - Use of incorrect or false data by clients. - Errors that clients may have made when making the booking. - Harm caused by the client's failure to keep their contact details up to date.
28. Changes to the terms of use
Kaikō Travel reserves the right to change the terms of use whenever it considers it appropriate. The user undertakes to review the content of these terms of use and the privacy policy, as they may be changed when necessary. Changes will not affect bookings made and confirmed beforehand, except where legally required. The user also declares that they understand and accept the conditions contained in this document.
29. Applicable law and competent jurisdiction
These terms and conditions are governed by Spanish law. Any dispute that may arise will be settled by the courts and tribunals that are competent in accordance with applicable law. Where the client is a consumer, the competent courts and tribunals will be those determined by the mandatory consumer protection rules. In all other cases, the parties will submit to the courts and tribunals that are legally competent, without prejudice to the rights that consumers have under current legislation.
