2. General terms and conditions of use

Purpose of the terms: the Website

The purpose of these General Terms of Use (hereinafter, the Terms) is to govern access to and use of the Website. For the purposes of these Terms, the Website means the external appearance of the screen interfaces, both static and dynamic, that is, the navigation tree; all the elements integrated into both the screen interfaces and the navigation tree (hereinafter, the Content); and any online services or resources offered to Users (hereinafter, the Services).

The Owner reserves the right to modify, at any time and without prior notice, the presentation and configuration of the Website and of the Content and Services it may include. The User acknowledges and accepts that the Owner may at any time interrupt, deactivate or cancel any of these elements of the Website, or access to them.

Access to the Website is open and, as a general rule, free of charge, without the User having to provide any consideration in order to use it, other than the cost of connecting through the telecommunications network supplied by the User’s internet access provider.

The Owner’s Website provides information, services and data related to the services offered by Kaikō Travel. The User is responsible for using the Website properly. This responsibility covers:

  • Using the information, Content, Services and data offered by the Owner in a way that is not contrary to these Terms, the law, morality or public order, and that does not in any other way infringe the rights of third parties or impair the operation of the Website itself.

5. Intellectual and industrial property

The Owner, directly or as assignee, holds all the intellectual and industrial property rights in the Website and in the elements it contains (by way of example: images, sound, audio, video, software or text, trademarks or logos, colour combinations, structure and design, selection of materials used, computer programs needed for it to work, be accessed and be used, etc.). These are therefore works protected as intellectual property under Spanish law, and both Spanish and EU legislation in this field, and the international treaties on the subject signed by Spain, apply to them.

6. Legal action, applicable law and jurisdiction

The Owner reserves the right to bring any civil or criminal action it deems necessary for the misuse of the Website and its Content, or for breach of these Terms.

The relationship between the User and the Owner will be governed by the legislation in force and applicable in Spain. Should any dispute arise regarding the interpretation or application of these Terms, the parties will submit it to the ordinary courts, before the judges and courts that are competent under the law.
